Information on the processing and protection of personal data of the mobile application Dřevěnky na Borek

The processing of personal data within the framework of the mobile application “Dřevěnky na Borek” (hereinafter referred to as the “Application”)

in accordance with Article 4(7) of Regulation (EC) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “Regulation”) and Act No 110/2019 Coll., on the processing of personal data, as amended, the operator is the Regional Council for Development and Cooperation based in Třinec, z.s., ID No.: 44741031, registered office: Nádražní 348, 739 61 Třinec, registered with the Regional Court in Ostrava, file no.: L 15755 (hereinafter referred to as the “Administrator”).

This privacy policy is designed to help you understand what information we collect, why we collect it and how you can update, manage and delete your data. Please note that when you use the App, the App will collect and use your information (as described below) in accordance with this Privacy Policy.

Personal data controller

The controller of the personal data collected in the application is the Regional Council for Development and Cooperation based in Třinec, z.s., ID: 44741031, registered office: Nádražní 348, 739 61 Třinec, ID No.: 44741031, (hereinafter also referred to as the “Controller”).

Purposes of location recording, processing and legal basis for processing personal data

First name, surname, or other user-selected identification for registration for both FO and PO, containing information, address, telephone number and user data. The personal data of the users listed may be processed for information purposes, but also for marketing purposes i.e. displaying advertising banners, sending updates and new functionalities. The legal basis for the processing of this data in this case is the legitimate interest of the Regional Council for Development and Cooperation based in Třinec, z.s., to inform about the development of the application.

The recording of the user’s location in is an essential component for the correct operation and provision of full functionality. In the event of deactivation of the location recording in the application, the location data will be non-shared and private; the legal basis for the processing of this data for this purpose is the consent given by the user to the terms and conditions of the application.

Data collection in the application

In use, your approximate location, if you choose to share it, will be visible to other users associated with the general username of the app and collects information to provide a better service to all its users – from locating your location to offering the distance of each stop and where you are exactly. The information the app collects and how that information is used depends on how you choose to use our services, including your privacy controls. The types of location data we collect depends in part on your device and account settings. The App may use information collected from you or provided by you for the following purposes:

To improve and correct the app’s services, Notification notifications regarding nearby attractions or events, or to improve the accuracy and correct errors in map data, location sharing information for emergency responders, or to improve GPS location.

The app may also collect other informational data, such as your information, which we also use to ensure that our services work as they should, such as tracking outages or troubleshooting problems you report to us. We use your information to improve the Service or to develop new features or services. To provide support, feedback and to handle complaints and requests.

Also to analyse the use of the application, how successful it is and which functions are most often used or not used, etc. also to send updates, notifications, but also to inform related services and also to conduct surveys and questionnaires

Based on your prior consent (to the extent required by applicable law), we may also use the email address you have provided to send you promotional or marketing materials. You can opt out of receiving such materials at any time by clicking on the “Unsubscribe” link in the email messages we may send you. In any event, the Application will not share your contact information with any advertiser unless expressly permitted or required by law. To protect the app, our users, the public and for legal reasons, the app does not sell, rent or lease your personal information to third parties.

Storage time

The personal data in the application will be stored with the Regional Development and Cooperation Council based in Třinec, z.s., for the period required by applicable law, if no such period is specified, for the period for which the legal reason for processing lasts or for the period necessary for the intended exercise or defence of legal claims. The Regional Council for Development and Cooperation based in Třinec, z.s. may entrust a third party as a processor with the processing of the personal data of the application. The controller is entitled to provide for the purpose of service support, monitoring, reporting, maintenance any personal data mentioned, such as address, e-mail address, first name, last name.

Right of access to and erasure of personal data

The data subject shall have the right to obtain confirmation from the controller as to whether or not personal data concerning him or her are being processed and, if so, to obtain access to such personal data. The data subject shall have the right to have the controller erase the personal data concerning the data subject and the controller shall be obliged to erase the personal data without undue delay if one of the grounds set out in the General Data Protection Regulation applies. The data subject shall have the right to have the controller restrict the processing of his or her personal data in the cases set out in the General Data Protection Regulation.

The right to data portability v and the right to object and withdraw consent

Subject to the conditions set out in the General Data Protection Regulation, the data subject has the right to obtain personal data concerning him or her which he or she has provided to a controller in a structured, commonly used and machine-readable format and to transmit those data to another controller without the controller to whom the personal data have been provided providing consent. The data subject shall have the right to object at any time, on grounds relating to his or her particular situation, to processing of his or her personal data processed for the legitimate interest of the controller, including profiling based on the legitimate interest of the controller. Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which shall include profiling insofar as it relates to such direct marketing.

The data subject shall have the right to withdraw the consent given to the processing of personal data at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent given prior to its withdrawal. Consent may be withdrawn by e-mail to the following e-mail address: sekretariat@regrada.cz, by written notice sent to the address of the controller’s registered office.

Applying rights in the application

The data subject may exercise the above-mentioned rights by means of an e-mail notification sent to the following e-mail address: sekretariat@regrada.cz.

Mobile Application Trustee

The controller has not appointed a data protection officer at the moment.

Right to lodge a complaint

The data subject has the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of his or her habitual residence, place of employment or place of alleged infringement, if he or she considers that the processing of his or her personal data infringes the General Data Protection Regulation. In the Czech Republic, the supervisory authority is the Office for Personal Data Protection.
